What can I do if I recently filed Chapter 13 but my car was still repossessed?
Question Details: At the time that I filed I still had my car in my possession. The whole purpose of me filing was to keep my car. How was repossession possible? Can I recover my car since I was covered under the bankruptcy laws?
If they repossessed it during the "automatic stay" period, then they acted illegally and you should be able to get the car back by filing the appropriate legal action or motion with the bankruptcy court; contact the bankruptcy court clerk for specifics. Bear in mind that the automatic stay, however, is only temporary (a few months): ultimately, if you do not pay or make arrangements to pay the loan, then after the stay period is over, the lender/financer will be able to repossess the car still--though if the car is worth less than the remaining balance of the loan/financing, they will not be able to sue you for that extra balance.
