Who is at fault if the pipes broke in rental house that were are leasing due to no oil in the tank?
Question Details: Over the holiday break, the renters were not in the house and the pipes broke due to there being no oil in the tank. It was suggested upon move in that the "oil man" would come monthly and fill as needed then send us a bill. The lease says that we are responsible for utilities.
If the lease says that renters are responsible for utilities, then the renters are responsible not just for paying the utility bills, but also for making sure that the heat, oil, electric, etc. are kept or maintained on. Damage due to a failure to keep oil in the tank would be therefore be the renters' responsibiity, for failing to ensure that there was oil.
