My friend got pulled over and the police found a small amount of drugs in his car, what can he expect to happen?
Or what can he say in court? Should he have a criminal law attorney? This is in New Castle County, DE.
There is no way to say with any precision what will happen, because so much depends on the context and facts. For example, is this your friend's first offense (much better for him)? What kind of drugs? (Generally, marijuana will draw less of a charge or penalty than an equal amount of cocaine, crack, or meth.) Where there any other crimes committed at the same time, including gun possession or, as you imply DWI? (When there are other crimes, it goes worse.)
You friend absolutely should get a criminal attorney to represent him. If he can't afford a criminal attorney, he should tell the court and he can get one appointed for him. He should not say anything (he should "take the 5th") until he has a chance to talk to any attorney.
