If I got married last year but my husband does not have papers and we have not put in his for his residency yet, however he has ITIN number to work, do we file taxes together?

YOu can file tax returns together but you need to find out whether he is eligible for adjustment of status to permanent residence on the basis of marriage or not. Did he enter the US lawfully or not? What was his immigration status at the time you got married?
