What can I do to get my property back from my ex-boyfriend?
If my ex-boyfriend has some of my property and won't give it back or has said he thrown it out, is there anything I can do, if so what? I asked him nicely to give it back because they are of importance to me. Its only been 2 days since he broke it off.
Conversion of property is a criminal and civil wrong. Conversion is generally defined as exercising dominion and control over the property of another without permission and to the exlcusion of the own's right. If you want to handle this civilly, you may file a lawsuit against your bf in court for conversion and sue for the turnover of your property and in the alternative, seek money damages for the fair market value of the property. Indeed, your bf has no right to your property and should give it back to you. I suggest that you first have a lawyer send this guy a letter warning him of legal action to save you the cost of a lawsuit as this may scare him to give your property back. You may also call the police and claim that your bf has converted your belongs. The police report will likely be the most effective way to go.
That depends. It appears from the onset that you may have a right to sue him for "conversion" which is "an unauthorized assumption and exercise of the right of ownership over goods or personal chattels belonging to another, to the alteration of their condition or the exclusion of the owner's rights." There may be certain requirements in your state in order to bring a lawsuit in this way. You should seek consultation. Maybe a good letter from a lawyer would be enough. Good luck.
