Can I be sued by a hospital for a bill after they sent the claim to the wrong insurance company?
In 2006 wife went to emergency room at a hospital. We submitted our insurance info to the billing office. The bill was sent to the wrong insurer. The claim was denied. We went back to the billing office and gave our info a second time. Again the billed our insurance company. Info giving to billing a third time. We followed up about 3 months later and was told everything was taken care of.Now, 4 years later we get a summons telling us we are being sued for this old bill. They also want 4 years worth of interest plus court costs.
If you can show that the reason the bill went unpaid was due to the negligence, errors, or omissions of the hospital's staff, you would have an excellent defense to the interest and costs, and a good defense to the basic charge. (Remember: ultimately, you are liable to pay for your medical care. It may be the case that you need to pay the hospital while seeking payment from your insurer at the time.) You should consult with an attorney experienced in these sorts of matters--health insurance, medical billing, etc. are very complex and given how much money is likely at stake, you probably should not try to resolve or work this out on your own.
