When getting a paraphernalia charge, am I supposed to be told what I'm being charged with or being given a citation for?
Question Details: I had 2 pipes and a grinder they confiscated all of it told me that I could go but I never signed anything or was told what the next step was. I could not drive home as I was intoxicated so they took me to the station fingerprinted me and took my mugshot which they would not have got if i was able to drive myself home. I was not driving; I was a passenger in a vehicle that was parked.
IF you are being charged or cited, you will get a summons in the mail and be aware of the charge. You are correct that you have to told this if charged or cited; it is possible, however, that since you were a passenger, not the driver, that the police blieve that taking the paraphrenalia (confiscating it) and trying to "scare" you by processing you is enough, and that they will not in fact charge you.
