What to do about getting back pay owed to me?
Question Details: My employer deposited a check into an account that I had told him was closed. The money refunded back to my employer and it's been 4 weeks but I still have not gotten a check or anything.On the Friday, I had another payday and I got that check deposited into my account. They said that they also deposited the previous one but it's not there and they keep giving me the runaround. I don't know what to do.
You can sue your employer for breach of contract / account stated. Your damages (monetary compensation you are seeking in your lawsuit) would be the amount you are owed. Depending on the amount of your damages, you may be able to file your lawsuit in small claims court.
