What happens if home is in the husband's name and he changes the mortgage before the divorce papers are filed?
Question Details: What will happen to my investment in a home built while married but mortgage in spouses name. We have been living seperated for over a year but no divorce paperwork has been started. We also have a child. The house was built during our marriage and we have lived in it throughout our separation.
You need to seek legal help on this matter. Tell your attorney. The house will be disputed. A proerty purchased or built during a marriage is considered marital property regardless of whose name it is in. Changing the mortgage to your detriment should be counted against him. But the facts will matter. Good luck.
