What can I do about a seller's misrepresentation?
Question Details: The seller said that there was a working water system in the house we purchased. However, when we moved in we called a water treatment company and found that the water softner is not working and the RO system was removed under the sink.
You can sue the seller for fraud: a seller is obligated to disclose the truth regarding the property, and a failure to do so is fraud. He could have legitimately known that the water softner had stopped working--it's not necessarily obvious when that happens--but he reasonably should have know that the system was removed under the sink. That fact suggest knowing fraud. You can sue for the cost to repair/reinstall the system.
