What can I do about a house that I bought new 11 years ago and is now falling apart?
Question Details: I've had many problems from day one. Now problems are getting extensive - roof repair (which insurance won't cover because they say shingles were improperly installed), several places on the ceiling are falling in or water stained, there are cracks in the foundation (not small hair line cracks but major cracks), the concrete is uneven and cracked, the floors are becoming unlevel and uneven and the door is not square and not sealing.
The problem is, at 11 years since you bought the house, you are long past the statute of limitations or time within which you must file or start a lawsuit for construction defects in your state, which is no more than 7 years after "substantial completion" of the home. Once more than 7 years have passed, it is to late to take legal action.
Unfortunately, 11 years is passed the period in which you can file suit against the builder. This time is known as the "statute of limitations". Once expired, no claims can be successfully pursued. In your state, you had 7 years in which to bring a legal action.
