No, this is not even remotely legal. It is in fact, several felonies, such as identity theft, tax fraud, lying on official government documents, etc. The illegal immigrant can be jailed or deported, or jailed then deported; and if the other person allowed the use (i.e. the SSN was not stolen), he can face prosecution, too.
