It goes back to whomever paid for and funded the reserve, typically either the at-fault person or business, or their insurer. The purpose of reserse is to ensure payment if necesssary; if payment is not necessary, there was no need for the reserve and the money and it goes back to the person who put the money up. There is no right for the injured party to get the money if it was not needed for medical expenses.
