If I lost my job due to refusing a random drug test, is there anything that I can do to get it back?
Question Details: I got selected today for a random drug test from my employer. I refused it even though I'm not on drugs. I smoked a little marijuana about 2 weeks ago and I knew that I wasn't going to pass. Is there anything that I can do like out-patient rehab to get my job back? I told them what happened but they acted like there was nothing I could do.
Unfortunately, unless your treatment violated the terms of an employment contract or union agreement, you have no claim here. The fact is that most work relationships are "at will". This means that a company can set the terms of employment much as it sees fit (absent some form of legally actionable discrimination).
