If my stepson’s mother taped our phone conversation without my consent, can it be used against me I court?

My stepson mother has taped our phone conversation without my consent and is threatening to use it against me in court. Is this a legal and did she commit a crime?

As a general rule, NY is what is known as a "1 party consent" state. Therefore, as long as one person consents to the recording it is legal. Accordingly, it can be used in court if the judge allows.
