How much notice to we have to give a month-to-month tenant to vacate?
Question Details: We're selling the house and the tenant is renting month-to-month. Th tenant agreed to showings, however, she is now being difficult and has limited showings to 1 day a week for 4 hours, making it impossible to get the viewings needed. What can we do as the homeowner? If we ask her to move, how much notice do we have to give?
The term "month-to-month" gives you the answer: you have to give her at least a month's notice, since her tenancy is for one month at a time. More: it has to be at least one full month, since tenancies begin at the beginning of a month and end on the last day. So, today is March 19; if she is month-to-month, it's too late to provide a month's notice for April 1 (i.e. that her last day would be March 31st and she'd have to be out on April 1). Rather, you can give her notice today for May 1st (April 30th last day), since that will be at least a month's notice.
