How do I know if I have a case against my insurance company for bad faith?
Question Details: My home was burglarized and I was working with the insurance adjuster. I had a lot going on and we were in communication over the sworn statement but she never once told me that if I did not get the sworn statement in on time, they would deny my claim . She kept telling me everything will be fine as long as were in contact but now they have denied my claim.
If they did not honor their obligation under the terms of the policy (which is a contract) to pay a covered claim, the insurer committed breach of contract. You can sue them for breach of contract for the money they owe you under the policy.
