Do I have to report a DUI during a job application if it was set aside?
Question Details: About 10 years ago, I got a DUI. 5 years later I got it set aside. Do I have to report this as a misdemeanor on a job application?
If by set aside, you mean any of dismissed, reversed on appeal, or expunged, then you do not need to disclose it, since the legal effect in any of those cases is a lack of a conviction...so even if cited or arrested for it initially, you do not have a misdemeanor conviction.
