Can my wife maintain full custody and not let me see our child if we get a divorce?
Question Details: My wife has been threatening me with divorce and tells me that she, "Has so much stuff on me" that I would not get custody at all. If we do get a divorce, can my wife maintain full custody and, if so, would I not be able to see my son at all? How does that work? Would I be able to see him at all?
Custody and visitation are separate issues. If your wife has custody of your son, you have a right to visitation with your son. Your wife cannot deny you visitation with your son. You also have the right to challenge her claim of custody in court.
