Can I take legal action against the builder?

My house was was built 9 years ago. My roof is now leaking due to improper installation.

Unfortunately, in your state (South Carolina), the "statute of repose" for a construction defect is only 8 years: in all circumstances, a lawsuit based on shoddy construction must be filed or started within 8 years of the substantial completion of construction. Once 8 years have passed, you can not bring a legal action. Based on what you write, too much time has passed to take legal action.
