Can I be sued regarding a paint job?
Question Details: I recently painted a fence for someone and they were unhappy with the outcome. The agreement I sent to them was through text message and I said "$350 paint"; that was all that was discussed from my end. They were responsible for getting the paint and I was only supposed to do the fence. The paint didn't turn out exactly the color they wanted and they are now threatening to sue. I offered to repaint the fence for free if they buy a more solid color but they are threatening to sue if I don't purchase the paint and paint it for free. Do they have a case?
If you did not provide them a "satisfaction guaranteed" warranty or guaranty, they would only have grounds to sue you and win if they can show that your work was not up to commercially acceptable standards--i.e. it was unreasonably sloppy or done incorrectly. You are not responsible for their choice of paint or dissatisfaction.
