Yes, you can be prosecuted for fraud for this if you truly opened them in your husband's name without his consent. While you could of course open credit cards in *your* name without a problem, you may not open credit cards in the name of another person, even a spouse, unless they consent or agree to it: to do so is to lie to the credit card issuer, and hence commit fraud.
