Am I entitled to anything if my husband never put me on the deed?
Question Details: We refinanced a home and at that time husband didn't include me on the deed. We purchased it 19 years ago and maybe 10 years later refinanced it. My name was on it but not since the refi. We have been married for 25 years.
Community property is property acquired during marriage, income during marriage and debt incurred during marriage. Each spouse has a one half interest in the community property.
Separate property is property, income and debt prior to marriage or after the marriage ends. A spouse has no claim to the other spouse's separate property.
Since your home was purchased during marriage, it is community property, and you have a one half interest in the home.
