If I live in one state and my husband lives in another, where should I file for divorce?
I live in CA and my husband lives in TX. We have been married for 8 years and have 2 children. I have resided here for the past 2 years. I am wondering where I should hire a divorce lawyer? In Trinity County, CA.
The general rule is that you can file for divorce in the state in which your spouse is a resident or in your state of residency. In CA once you lived there for over 6 months you established legal residency. The fact is that when children are involved it might well be advisable to have legal representation. If you want to know more about filing for yourself, here is a site that you may find to be of help: http://www.courtinfo.ca.gov/selfhelp/family/divorce/index.htm
