What is the statute of limitations for health care providers billing patients?
Question Details: I was sent notification that I am being charged for health care services that occured over 3.5 yrs. ago. What is the statute of limitations?
Ohio has three different statutes of limitations for contracts: written contracts, oral contracts and contracts for sales of goods all have different time limits on when a lawsuit can be filed to enforce a breach. The shortest of those is for sales of goods, which is four years. Since it's unlikely that you received these services without signing for them, it's most likely that you're working under the longest period, for written contracts: 15 years.
It doesn't really matter. No matter how you view it, the health care provider can still sue you for this bill.
