If someone stole my paycheck and cashed it what can I do?
I already went to my boss about it. She went to the police and to the bank. They both told her not to give out any more money to me. It's been to weeks and I haven't even got a phone call about it. Can I take this in my own hands? Should there be some kind of way that I can track to see where it was cashed? What can I do?
What concerns me here is that they bank and police told your boss not to reissue your paycheck. Are you under investigation for fraud in reporting this transaction? Yes, you do have rights and you should look in to exercising them. I would start with you state attorney generals office and your state banking commission. I would approach your boss and inquire as to what is going on. The bank has insurance that would benefit your employer so if your employer does in fact get reimbursed for the funds you should benefit from that reimbursement. You employer may also be insured for this typ eof theft so ask about claims made in that regard. Good luck.
Yes, it should be possible to at least find the branch or institution where the check was cashed, especially if there has been a police report on the matter; your employer should be able to have their bank (the bank the check is drawn on) confirm where the check was cashed. From there, it may be possible to find out who deposited or cashed it (though it's not certain you'll be able to find that out; if the check was cashed and not deposited, there may not be a record, and also the other institution may not be willing to help out without some legal process compelling them.)
If you employer doesn't want to ask the bank to do this, you might need to consider whether your employer had a hand in the theft or already knows who did this--it would be very unusual for an employer to NOT want to help an employee in this situation.
Also, why is no more money being given to you? Does that mean you are not receiving your paychecks? That would be very strange--you may wish to speak with police and/or the bank yourself, if you haven't already, if you this is the case and you are not satisfied with the explanation you are receiving. Make sure you understand and agree with what's been said and what actions are being taken.
Note that if someone was negligent, and that negligence allowed your check to be stolen--for example, your employer left it out in plain sight or in a public area, where someone could pick it up--you may have a cause of action against whoever's negligence led to the theft.
