Rear end auto accident. What are my rights?
Question Details: I hit the bumper of another vehicle when coming to stop at a red light (5pmh). There were no injuries, damage or police report filed. I provided my info willingly at the scene, but she didn't give me hers. She called me 3 days later to tell me she was OK, had no injury, no damage to her vehicle, so she would not file a claim. However, today my insurance company contacted me to let me know that she changed her mind and IS claiming both. What are my rights? Can I fight this? I have photos and her voice mail that prove no bodily injury or damage to her car.
I am a CA lawyer. Since you have insurance coverage, turn the matter over to your carrier. They will do the fighting for you. Anyway, if the damage to her car is small, it can be hard to find a lawyer who will take a case like that. Most lawyers know that "low speed impact" cases are very hard cases, even with admitted liability. Good luck.
