My landlord is holding my personal belongings for late payment of rent, what can i do to get my belongings back?
Question Details: I ran into some money issues in June and could not make all my rent. On July 3rd the landlord served me with a 10-day notice to fix the situation. July 5th he nailed the door shut. I spoke to him today but got no where with him. He stated that until I paid all of June and July I could not get in to get any of my stuff.
I am not admitted in Alabama, but it appears that your landlord has attempted to serve you with what is required under the law - maybe - but has really resorted to self-help by nailing the door shut. There is no order of eviction. You have a right to be in the apartment albeit an obligation to pay rent. What he has done could be conversion of property but again, I am not familiar with your statelaws. Go down to Landlord Tenant court in the area in which you live. The clerks are usually very helpful to pro se litigants (people without attorneys). You still have an obligation to pay the rent under the lease and your landlord will probably countersue you for it. But at least you may be able to get your things.
