My father died without a will, as an only child how do I get what I am entitled to from my mother?
My father died in 03/09 and he had $15,000 in 2 vehicles that were in his name only. My mother did not turn his assets over to probate or give me my share of the $15,000. How can I get my share?
I am sorry for your loss. It all depends on how the vehicles were titled. If they were jointly titled and/or you state allows you to name a beneficiary on the title then they might have passed to your Mother at the time of your Father's death by "operation of law," meaning that they were hers upon his death. Did she probate a small estate for your Father?
If your Father's assets in his estate were below $35,000.00 then in Ohio you can apply to the Probate Court for a Release of Assets Without Administration. See if this was done and go from there. Ask an attorney in your area to explain once you have all the information. Good luck.
