How can I get rid of my ex-roommates belongings without getting into legal trouble?
My ex-roommates were supposed to be moved out by September 1st. They took a lot of their stuff but they still left a lot and they are refusing to remove it from our apartment. I have contacted them and tried to solve the problem but they are refusing to cooperate. Currently they are still on the lease but I am working to get them removed from it. What can I do to get their stuff out of my apartment without getting into legal trouble?
You are not permitted to simply throw your ex roommates property away. However, you do have remedies. The general rule is that when people are placed on notice that their property is subject to disposition, and they fail to take any action they are not permitted to take any legal recourse against the person disposition of the property. In this case, you want to make sure that you send the ex roommates a certified letter stating that they have 3 weeks to come and get their property before you discard it. you should also write a letter a week before the due date as a final reminder. make certain that you send these letters certified mail so that you can prove with the green card that the ex roommate received notice. that way, they cannot complain later.
