Must an employee repay a mistaken overpayment?
My employer gave me a $2.00 hr. raise plus double commission after 56 hours a week for three months. The say it was a HR mistake and want repayment. They say they are going to take it all back from one check. Is this legal?
If you were mistakenly overpaid, then yes you are legally obligated to pay it back. Otherwise you would have what is known in the law as "unjust enrichment". However, you should be able to work out a re-payment arrangement. After all, you weren't given the overpayment in a lump sum.
