Living in Arkansas, and my husband dies without a will
My husband died without a will and he had 4 children (my step kids) and I have 2 children. We owned 3 houses and had been married for 27 years. One of the children wants to take her dad's share; is that possible? And what happens if I die with a will and leave everything to my children? I I have given his children what they asked for. Can they ask for more? My house? My property that I paid for? He retired 13 years before he died and I continued working and didn't retire until recently. Do my children have anything left when they are done?
His children will take his share of the estate if he died without a will. You will keep your half. His estate is subject to several different exemptions would go to you, such as dower, curtesy, the homestead exemption, etc. These exemptions are complicated and would take too long to explain here. Suffice it to say any property transactions to his children should probably be supervised by an attorney. If I can be of assistance, please let me know.
