What is the liability to the registered owner of a car in allowing an unlicensed driver to use it?
I am 21 and driving with a revoked drivers license. I am not eligible for a limiting driving privilege of any kind and only use the vehicle to go to work and school. I am still listed as insured under my insurance policy (insurance company is not aware my license has been revoked because the policy was just "renewed"). The car I am driving is titled to my parents. What would happen if I were to get into an accident? Could they be sued or would I be solely responsible?
Most states, and I am sure MO, have statutes that criminalize driving without a license or a license that is revoked. What is the basis for your license being revoked? Depending on the basis for the revocation, you may be subject to jail time (i.e. if underlying reason is a DWI) or a fine or both. If you are in an accident that is your fault, you as well as the owner of the car are liable for the damages. The owner's insurance policy will be triggered if you are on the policy. However, if the policy has an exclusion for drivers that have revoked driver's licenses, then the owner will have to pay out of pocket and not be able to use insurance. I suggest that you not drive at all and try to get a valid license as you do not want to get arrested.
