Is it illegal to take a spouse off your health insurance before divorce is final?
We have filed for divorce but do not have a separation agreement or anything; the divorce hearing is not for months. For how long after a divorce can you keep an ex on your insurance? I heard there was a new federal law that lets you stay on with an ex's health insurance company for a couple years. I'd be happy to pay the premium myself, I just would like to keep the policy if possible.
It's not a new law. COBRA gives a newly-divorce ex-spouse the right to continue coverage, from the company that provides the other ex-spouse's coverage, for up to 18 months, at the expense of the ex-spouse. When your divorce goes through, you will get a COBRA notice; you have to respond to that, in writing, and pay the premiums absolutely on time (and you'll find that it's far from cheap). Once you are divorced, you are no longer eligible for coverage under your ex's insurance, directly.
