Can I get emancipated without my mother's consent?
I'm 16, pregnant, and have a 15 month-old son. I need to be emancipated to live with the father to be able to provide a better life for my children. I can't do that living with my mom for many reasons. Emancipation is my best option but my mom won't agree to sign the form. Is there any possible way for me to do it without her signature?
In order to live separately from your mother, you must petition the court to have the "disabilities of minority" removed. You must be: (1) 17 years old, OR at least 16 years old and living separate and apart from your parents and (2) self-supporting and managing your own financial affairs. Furthermore, a parent must verify your petition.
You don't seem to qualify for several reasons. First, while you may be 16, you are not living apart form your parents. So you would have to wait until you are 17. Second, you do not appear to be supporting yourself (job) and managing your own financial affairs. Third, your mother will probably refuse to verify your petition. I don't think a court would grant your petition anyway because you show no ability at this time to take care of yourself, You are very young with 2 children. This makes it difficult for you to get a job, especially if you don't finish your education. It will be difficult to provide a better life for your children under these circumstances.
Perhaps you can find resources at your school or social services in your area. They can advise you on ways to become more self-sufficient and help you with childcare while you finish your education and get a better job. Then you can move out and be independent. Best of luck to you and your children.
