Question Details: I will be moving soon. HOw many days notice does the law say I must give my landlord? I have lived in this rented house for over 10 years. Must the notice be in writing? Does the law say I can pay landlord a partial payment if I am not staying the entire month? My rent is due every 13th of the month. If I am moving out by the 28th of the month, how is it calculated? Please advise.
You have to give your landlord one full month's notice, and it really should be in writing, keeping a photocopy for yourself, just so you can prove it later if necessary. By a "full month," it's a full "rent month, in your relatively unusual case, starting on the 13th; if you give notice on the 14th, it's the same as if you give it on the 13th of the next month. So if you are planning to move out on the 28th of this month, you need to give notice today or tomorrow, so you won't be liable for the rent for the month starting October 13th.
You do have to pay for the full month, even if you're not going to be staying to the end.
