If I am on probation for a DWI, is a gun allowed to be in my home?
I am trying to find out the rules regarding probation for a DWI and owning weapons NC. Someone told me that it is a condition of probation that there be no guns in the home during the 18 months of probation. She said that the Probation Officer does not want the Probationer to have weapons in the home when he/she conducts a home visit. Since I have not been convicted of a felony, do I have to give up my second amendment right to own a weapon in my home just because my PO does not want me to have a weapon in the home? Can they take my guns?
It is my understanding that it depends on how you were sentenced to probation: supervised or unsupervised, and the specifics of your terms.
DWI is a class 2 misdemeanor. It is not a felony, and it does not cause you to lose the right to vote or to own a gun. If you are placed on unsupervised probation, however, one of the conditions of probation in North Carolina will be that you possess no firearm or other dangerous or deadly weapon during the period of probation. If you hunt or otherwise own guns you need to speak with your attorney right away. Violating probation is a serious issue.
