Question Details: This is my second, and last, offense. I was stopped at a checkpoint. The cop "smelled" it in my car and asked to search me, I said ok and she found it in the car. I already have a lawyer that has dealt with the calhoon county district attorney, he does not think I will get jail time and is telling me to sleep easy, but I cannot. There is not minimum jail sentencing for second offense LTA, I'm not worried too much I just need to know what to do other than have a good lawyer I already have. Do you think going to **** rehab meetings will increase my chance of probation/freedom?
I am a lawyer in CT and practice in this area of the law. I think that the classes will look good. anything that ou do between now and the next court date to show that you are acknowledging that you have a problem and that you are taking steps to help yourself.
Although I do not practice law in the State of Alabama, here are my initial impressions. Although I generally agree with my colleague's comments, I'd like to add another perspective. If you already have an attorney, you should really sit down with him/her and discuss this in detail. You have paid your attorney to represent you and to give you advice -- and you should take advantage of that. Your attorney, who is familiar both with the specific details of your case as well as local law/procedure, is really in the best position to advise you in this regard. Good luck.
