How long is the time frame from an incident that you can file a civil suit?
I was sprayed with mace by the Sheriff's Department and they rubbed it in my face afterwards. I just want to know the time frame of filling a civil suit.
The statute of limitations varies from state to state. When you sue a town/city based on what appears to be a civil rights violation you have to place the city on notice within a certain period of time after the incident or you lose your right to make a claim. The time amount again, varies from state to state. In other states, you may simply go by the applicable statute of limitations. The statute of limitations governs the time limit for filing a case. Civil rights violations generally have a 2 year statute of limitations regarding battery/assault. The officer's conduct that you describe constitutes batter/assault based on the contact. I suggest that you immediately hire a lawyer to get involved and bring the police report to him. You may need to get whatever charges that you may have been issued dismissed/nollied in order to go after the police here.
