I filed for Chapter 13 bankruptcy and couldn't make my payments so it was dismissed. What are my options?
I was working and filed for Chapter 13. I was making payments to my trustee but then became unemployed and 4 months later I stopped making payments. My chapter 13 was dismissed and I was unemployed for 18 months. All the collection agencies have been calling me and things got worst during my unemployment. Now, as of 3 months ago, I am back to work but I am only making half of what I did when I worked and less then what my unemployment benefit was. Is there anyway I can re-file or re-start my Chapter 13 after all this time?
In answer to your question, yes, a Chapter 13 can be re-filed at a later date. There are some limitations if done so within 180 of dismissal but you are well passed that. You would, however, be responsible for new filing fees. You would also once again have to show that you could keep a repayment plan. Given your financial situation, you may want to explore filing a Chapter 7.
