How can a co-signer get possession of car if the other co-signer has defaulted on the loan payments?
The person having the car has defaulted on several payments and repossession is looming. We are listed both as "OR" on the documents. Also registration hasn't been payed for 6 months now (just found out) and there are unpaid parking tickets. If I would pay off the car loan at once, would I get the title? If so, how can I get the car if the person is not returning it on free will?
If you are listed as OR you may not necessarily be a co-signer. Look at how the title is written (check with the lender/dealership). If you are indeed an actual co-owner (and not just a surety on the loan), you can take the car anytime (have it towed) and pay off the loan. In terms of unpaid parking tickets, you may need to pay those and then simply sue the former owner (current owner) for the money.
Once the car loan is paid off, the title may actually be in both of your names, then at that point the other owner would have to sign his portion to you.
