Question Details: HAVE PAID SEVERAL THOUSANDS OF DOLLARS AND STILL HAVE NOT COMPLETED WHAT I NEED DONE IT HAS BEEN THREE YEARS AND COUNTING.
I am not admitted in Illinois. Generally, you can fire your attorney at any time but you will be bound by the retainer agreement. Usually the new attorney will negotiate the fee dispute and a lien is placed on the file. Do not fire your old attorney before your new attorney is in place.
However, if you are disputing the fee then ask for an accounting. That is your right as well. You may have to get a new attorney, pay her/him a retainer as well, and then sue the old attorney for the file and to resolve the fee dispute. Unfortunately, you are stuck in the middle but you need to do something to resolve your unhappiness all the way around. Good luck.
