How much jail time will I do for a first offense assault?
How many days in jail will I do for a first offense assault 4 in OR? The plea was for 10 days. That seems like alot.
Assault is a crime of violence, even at a misdemeanor level, so it's very hard for anyone to say that 10 days in jail is too much. Ordinarily, assault charges are only prosecuted if the victim suffers some injury, or if there was a more or less major public commotion, or something else got the attention of law enforcement. It might be that 10 days is a bit stiff, but not what you'd call harsh; it might also be, depending on what happened, that 10 days is a bargain you should take and say "thank you" for.
The law frowns, especially, on violence. The whole point of having a legal system is that it is much more pro-civilization than "might makes right."
I would like to offer a different perspective. You have stated that "the plea was for ten days." Therefore, if you are stating that you have already plead guilty and have been sentenced to 10 days, then you may very well serve ten days incarceration. Whether you will be let out earlier will depend on local DOC procedure, as well as how crowded the facilities are, not upon the specific crime that you have pled to. If, on the other hand, you have been OFFERED ten days but have not actually pled guilty, then the resolution of your case in the event that you refuse the offer will depend on a myriad of factors.
