Ex wife did not repay student loan that she forged my name as cosigner
Question Details: My ex wife took out a student loan two months before we filed for divorce. She forged my name as cosigner. She did not disclose this particular student loan in divorce papers. Although papers state she is to repay her student loans. She did not repay loan, filed bankruptcy, and now they are coming after me. Do i need to file a criminal forgery charge? Or sue her for contempt of the divorce decree?
It sounds like a forgery complaint would be appropriate, although that won't necessarily help you with the lender in the short term.
You might need to hire a handwriting expert, unless the forgery is fairly obvious.
You need a lawyer to deal with both the lender and your ex-wife. You won't be able to go after her in the divorce court, until and unless you can get relief from the automatic stay of all non-bankruptcy legal action against her, that the bankruptcy law provides.
