eviction without lease
Question Details: my friend has no lease and has not paid rent in about 2 months.they planned on moving anyway but have now been given a letter from their landlord stating they have three days to be out.is that so?
Your friend has just received their "3 day notice to quit" for non-payment. If they are not out at the end of that time, the landlord can commence an "unlawful detainer" proceeding (eviction). My understanding is that in Florida this can be obtained in a little as 2 weeks. If they are not out by then, the sheriff will forcibly remove them. Additionally, the landlord can then sue them for back rent and related eviction costs. If they win and get a judgment they can then garnish (seize) your friend's bank accounts/wages. In fact, even if they are out in 3 days the landlord can still sue for back rent.
You should tell your friend to pay what they owe and vacate ASAP.
