Do I have to repay food stamps and medicaid I've recieved if I get my SSI
I have been receiving medicaid and food stamps since having breast cancer and a heart attack almost 5 years ago. My SSI appeal is still in progress. I have recieved a form from the local welfare office to sign saying they are entitled to my first retroactive check (if I'm approved) can they make me pay all this back?
Supplemental Security Income (SSI) is a need-based cash assistance program. SSI is for people with limited income and assets. Adults can get SSI if they are age 65 or older, disabled, or blind. Children can get SSI benefits because of disability or blindness. However, the value of food stamps is included in SSI. In other words, SSI is meant to cover some of your monthly expenses, including food. So you cannot collect both. Your retroactive SSI payments would in effect be a double food allowance. Therefore the state is entitled to reimbursement for those amounts (i.e. the amount paid out for food stamps).
As far as I can tell you are permitted to receive both SSI and medicaid at the same time. So you need to ask your local welfare office exactly what is being reimbursed to the state and how much.
