conspiracy charges if **** manufacture crime is not charged
Question Details: Can an individual be charged with conspiracy to manufacture drugs, (for obtaining the base material), if manufacture of meth was not proven? West Vriginia, individual bought Sudafed several years ago... Son recently charged with manufacturing meth in their home...so purchase was unrelated to current charge. What's your opinion of likelihood that parent can be charged with conspricay to manufacture drugs. (signature is on file with **** store)

The general rule is that a defendant can be charged with conspiracy to commit a crime, regardless of whether that crime was actually committed, if there is probable cause to believe that the defendant intended to commit the crime (along with someone else) and that a substantial step towards the crime's commission was taken.
