Can the hospital sue me over a bill that I am paying on each month?
Question Details: I've always been told that if they cash your check, the business is agreeing to that payment. Every month I send $50 which is all I can afford, but they sent me a lawsuit paper saying that they are suing me for NON-payment.

I am a lawyer in CT and practice in this area of the law. what you are referring to only applies whether the debt is in controversy as to the amount the parties believe is owed. here, the debt is a known amount. you choose to pay less because you cannot afford to pay the full amount. The payments are not enough and therefore, the hospital is permitted send the lawsuit. i suggest hiring a lawyer or trying to negotiate with the lawyer to get on a payment plan you can afford as the lawyer is likely going to agree to letting you pay a smaller amount to avoid you filing bankruptcy and getting rid of the debt altogethe.
