Can I sue my ex-husband for harassment?

The harassing messages and phone calls would constitute intentional infliction of emotional distress.
Your lawsuit could also include a separate claim (cause of action) for invasion of privacy. Invasion of privacy is a serious and unreasonable interference with one's right to be left alone. The harassing messages and phone calls are a serious and unreasonable interference with your right to be left alone and therefore constitute an invasion of privacy.
