About Florida Condo Law... Can the Treasurer of a Condo Association write a check that is not authorize by the Board of Directors out of Reserve funds
Question Details: We have a Treasurer of our Condo Association and he and the President leave the rest of the BOD out of the loop. Last year the President contracted with a painting company to paint the buildings and took money out of the Reserve funds and paid for 2 large buildings without BOD approval. Is that legal?
It may not be illegal in the sense of criminal -- at least, not necessarily. But it certainly calls for someone to take a close look at the Condo Association by-laws and so forth, because it doesn't sound proper.
Ordinarily, many associations have provisions for someone to act for the Board, without a meeting, in an emergency, or for minor amounts. But this doesn't sound like an emergency, or a minor expense.
If the buildings needed painting and the price was fair, there may not be anything to be done at the bottom line. But if money was spent unnecessarily, it's possible that the people responsible could be made to pay it back out of their own pockets.
